Waiver, Release and Hold Harmless Agreement
THIS DOCUMENT IS A LEGAL CONTRACT
This agreement releases Saveur the Journey, LLC (TOUR OPERATOR) from all liability relating to injuries that may occur during “Italian Alps Ski Trip” in Italy and France February 17-25, 2023, and/or extension February 25-March 2, 2023. By signing this agreement, PARTICIPANT agrees to hold TOUR OPERATOR entirely free from any liability, including financial responsibility for injuries incurred, regardless of whether injuries are caused by negligence.
PARTICIPANT also acknowledge the risks involved in Skiing/Snowboarding visiting farms and eating bubbling cheese. These include but are not limited to falls, impacts, avalanches, tree wells, rocks, trees, ice, cliffs, ski lifts, gondolas, farm equipment, animals, burns, traffic accidents and molten cheese. PARTICIPANT swears that PARTICIPANT is participating voluntarily, and that all risks have been made clear to PARTICIPANT. Additionally, PARTICIPANT does not have any conditions that will increase likelihood of experiencing injuries while engaging in this activity.
PARTICIPANTS will be respectful to all members of our group including leaders, guests, and other participants. Saveur the Journey, LLC is committed in all areas to providing an environment that is free from harassment. Harassment based upon an individual’s sex, race, ethnicity, national origin, age, religion or any other legally protected characteristics will not be tolerated. All participants, including supervisors and other management personnel, are expected and required to abide by this policy. Any participant or leader who engages in improper harassing behavior will be subject to disciplinary action which may include removal from the trip and the forfeiture of trip cost.
TOUR OPERATOR cannot ascertain all possible risks. PARTICIPANT is fully responsible to independently research all of the risks of this trip. PARTICIPANT has carefully considered the known risks, and assumes all risks, holding TOUR OPERATOR harmless for any damages, injuries or claims for both known and unknown risks.
PARTICIPANT understands that in the event of any injury, illness, economic loss, detention or death, TOUR OPERATOR is not liable. The possibility of personal injury, emotional trauma, illness, unanticipated event, death, loss or damage to property is entirely at the PARTICIPANTS own risk. Any risk, dangers and hazards of the activity are fully understood and assumed by the PARTICIPANT.
PARTICIPANT agrees to waive any and all claims against the TOUR OPERATOR arising from the participation in the trip. The agreement will be effective and binding upon heirs, next of kin, executors, administrators and all persons who may be entitled to assert a claim as a result of an injury to the PARTICIPANT.
Photo Release
I agree to grant to Saveur the Journey, LLC and its authorized representatives permission to record on photography film and/or video, pictures of my participation. I further agree that any or all of the material photographed may be used, in any form, as part of any future publications, brochure, or other printed materials used to promote Saveur the Journey, LLC, and further that such use shall be without payment of fees, royalties, special credit or other compensation.
The TOUR OPERATOR confirms being mentally and physically fit and fully able to participate in the trip. A parent or guardian must read and sign the agreement on behalf of PARTICIPANTS under 18 years of age.
By signing below I forfeit all right to bring a suit against Saveur the Journey, LLC for any reason. In return, I will participate in Saveur the Journey, LLC’s “Italian Alps Ski Trip” and/or “France Ski Extension”. I will also make every effort to obey safety precautions as listed in writing and as explained to me verbally. I will ask for clarification when needed.
